How to Remove the Conditions on My Permanent Residence?


Question:

I have married to a U.S. citizen, and have received a conditional Green Card (Conditional Permanent Residence). Please let me know how to remove the conditions on my permanent pesidence?

Answer:

If you have been married to the U.S. citizen petitioner for less than two years at the time your Form I-485 is approved, USCIS will grant you lawful permanent resident status for two years on a conditional basis.

A conditional permanent resident receives a Green Card valid for two years. To remove the conditions on your permanent resident status, you must file a petition within the 90-day period before your conditional Green Card expires. You cannot renew your conditional Green Card. If your conditions are not removed, you will lose your permanent resident status and you will become removable from the United States.

You will need to meet additional requirements and file a Form I-751, Petition to Remove Conditions on Residence before USCIS will remove those conditions.
To remove conditions on a Green Card for entrepreneurs, you must file Form I-829, Petition by Entrepreneur to Remove Conditions.
