We Were Wondering If It Is Better for Us to Marry before She Gets Her Green Card

I am a citizen of Peru. My girlfriend's green card application filed by her U.S. Citizen parents is pending. So, we were wondering if it is better for us to marry before she gets her green card or wait until after she receives her green card? 


Answer:

As an unmarried daughter of a U.S. Citizen, your girlfriend currently falls under the 1st Preference in obtaining a visa number. If she were to get married, her preference would then change from the the 1st preference to the 3rd preference category. Based on the current Visa Bulletin, the 3rd preference is an additional one year waiting period as opposed to the 1st preference category. 

However, if your girlfriend decides to wait until she receives her green card and then marries, she would have to sponsor you, which may take longer then 5 years before you can obtain your green card. Therefore, it appears that getting married now would be less time for you to get your the green card.
